1. Scope

These Terms of Service apply to orders placed through our online shop at https://zimeo.uk/.

These terms apply to consumers and to customers acting in the course of a business, trade or profession.

A consumer is a natural person who enters into a contract for purposes that are mainly outside their trade, business, craft or profession.

Any terms and conditions of the customer apply only if we have expressly agreed to them.

2. Products

We sell goods through our online shop, including personalised products.

Depending on the product, customers may provide personalisation details such as names, text, dates, images, photos, designs or other information required to create the product.

The main features of each product are shown on the relevant product page.

3. Placing an order and conclusion of the contract

You can select products in our online shop, personalise them where applicable and place them in the shopping cart.

Before submitting your order, you can review your order details, correct input errors or cancel the order process.

The contract is concluded when you submit your order by clicking the final order button that clearly indicates an obligation to pay.

After placing the order, you will receive an order confirmation by email.

You are responsible for ensuring that the email address provided during the order process is correct and that emails from us can be received.

4. Personalised products and customer content

Personalised products are made based on the information, text, names, images, files or other content provided by the customer.

The customer is responsible for ensuring that all personalisation details are correct, complete and suitable for production. This includes, in particular, spelling, names, dates, text, colours, images and other design elements.

The customer must ensure that any content provided does not violate applicable law or third-party rights. This includes copyright, trademark rights, name rights, personality rights and other intellectual property rights.

If a third party makes a claim against us because of content provided by the customer, the customer must indemnify us against such claims and reasonable related costs, to the extent that the claim is caused by the customer’s content.

If a proof, preview, draft or correction template is provided before production, the customer must check it carefully. Production will be carried out based on the content approved or confirmed by the customer.

We are not responsible for errors in personalised products if the product was made according to the information, files or approval provided by the customer.

5. Prices and payment

The prices shown in the online shop are total prices and include applicable taxes, unless stated otherwise.

There are no shipping costs.

The payment methods available to you are shown during checkout.

Payment methods may include, in particular:

  • PayPal
  • Amazon Pay
  • Google Pay
  • Apple Pay
  • Visa
  • Mastercard
  • Maestro
  • American Express

Unless otherwise stated for a specific payment method, payment is due when the order is placed.

Payment may be processed by external payment service providers. The availability of individual payment methods may depend on the delivery country, order value, payment provider checks or technical availability.

6. Klarna payments

If you select a Klarna payment method, payment will be processed through Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden.

Klarna payment methods may include Pay Later, Pay Now, invoice, direct debit, credit card, instant bank transfer or other options shown during checkout.

The use of certain Klarna payment methods may be subject to identity, address or credit checks by Klarna.

7. PayPal Checkout

If you select a payment method offered through PayPal or PayPal Checkout, payment will be processed through PayPal or through payment services integrated by PayPal.

The payment methods actually available to you will be shown during the online order process.

8. Delivery

Delivery conditions, delivery times and any delivery restrictions are shown in the online shop, on the product page or during checkout.

If an order contains several items with different delivery times, we may ship the order in one delivery unless otherwise agreed. In that case, the delivery time is based on the item with the longest delivery time.

For consumers, the risk of accidental loss or damage to the goods passes to the customer when the goods are delivered.

For business customers, delivery and shipping are at the customer’s risk to the extent permitted by law.

9. Retention of title

The goods remain our property until the purchase price has been paid in full.

10. Cancellation rights and refunds

Consumers may have a statutory right to cancel distance contracts.

Details are set out in our separate Refund and Cancellation Policy.

For goods that are not prefabricated and are made based on an individual choice or decision by the customer, or goods that are clearly personalised, cancellation rights may be excluded. This applies in particular to products made with personalised names, text, dates, images, photos, designs or other customer-provided personalisation details.

This does not affect your statutory rights if goods are faulty, damaged, defective or not as described.

11. Statutory rights and warranty

Statutory rights apply.

If a product is defective, damaged or not as described, the customer has the rights provided by applicable law.

For personalised products, an error caused by incorrect, incomplete or unsuitable information provided or approved by the customer is not considered a defect if the product was produced according to that information or approval.

12. Contract language and order data

The contract language is English.

Before submitting the order, the customer can review, save or print the order details using the browser functions.

After the order has been placed, the order details and these Terms of Service will be sent to the customer by email.

13. Applicable law

German law applies.

For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

The UN Convention on Contracts for the International Sale of Goods does not apply.

14. Place of jurisdiction for business customers

If the customer acts in the course of a business, trade or profession, our place of business is the place of jurisdiction to the extent permitted by law.

Mandatory statutory places of jurisdiction remain unaffected.

15. Alternative dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before consumer arbitration boards.
